EVENT TERMS & CONDITIONS

These Terms & Conditions, hereinafter referred to as the “Terms & Conditions,” are issued by Tomasz Ochab, conducting business activity under the business name Tomasz Ochab Knock Out Productions, service address: ul. Armii Krajowej 12/LU9, 30-150 Kraków, entered into the Central Registration and Information on Business of the Republic of Poland kept by the Minister of Economy, NIP (Tax ID No.): 6772280971, REGON (National Business Registry No.): 120675989, email address: info@knockoutprod.net, hereinafter referred to as the “Organiser.”

The Terms & Conditions lay down the rules for participation in the artistic, entertainment, or sports event, hereinafter referred to as the “Event,” organised by the Organiser. The Terms & Conditions apply to all persons present in the Event area, with the proviso that a separate regulation issued by the Organiser may apply to certain Events, which will be explicitly indicated in the text of such regulation.

The right to enter the Event area is granted to persons who have presented an entry ticket to the Event containing a unique barcode issued by the Organiser, or who have received an individual right to enter the Event area from the Organiser, subject to points 4 and 6. A collector's ticket is not an entry ticket – it does not entitle the holder to participate in the Event.

Minors who are under 16 years of age at the latest on the day preceding the day of the Event have the right to enter and participate in the Event only under the care of an adult who takes responsibility for the minor during the Event. One guardian may supervise a maximum of one minor at the Event. The guardian of a minor is obliged to possess entry tickets – for themselves and for the minor (subject to point 5) – as well as a document confirming the child's first name, surname, and age.

A minor under 13 years of age may enter the Event under the care of an adult upon presentation by such adult of a “Family Entry Ticket” or two regular entry tickets (for the adult and for the minor) and a document confirming the child's age.

A “Family Entry Ticket” entitles one minor and their single adult guardian to enter and participate in the Event. Under the “Family Entry Ticket,” the minor and their guardian are not entitled to seats at the Event, but to standing areas. The pool of “Family Entry Tickets” issued by the Organiser is limited.

An entry ticket issued by the Organiser becomes invalid the moment the participant leaves the Event area. Leaving the Event area is equivalent to resigning from participation in the Event, and in such case, the entry ticket does not entitle the holder to re-enter the Event area.

Security services appointed by the Organiser shall be present in the Event area, whose task is to ensure the security and safety of the persons present in the Event area, hereinafter referred to as the “Security Employees.”

During the performance of their duties, Security Employees are obliged to carry a qualified physical security guard ID card, as referred to in the provisions of the Act of 22 August 1997 on the Protection of Persons and Property, and to present it upon request of the person whom the activities concern, in such a manner that the interested party has the opportunity to read and note down the first name and surname of the security employee, the ID card number, the details of the issuing entity, and to familiarise themselves with the text of the instruction on the statutory powers vested in its holder. The Security Employee is exempt from the obligation to present the ID card if the behaviour of the person against whom they are performing activities obviously poses a threat to the life or health of the Security Employee, other persons, or the property under protection.

Persons present in the Event area are obliged to carry a valid identity document, which shall be understood as: an identity card, a temporary identity certificate, a passport, a driving licence, a school or university student ID card, a document establishing the identity of a foreigner, or any other identity document equipped with a face image and age. At the entrance to the Event area, Security Employees may demand that the person entering the Event area present such document.

Persons present in the Event area are obliged to behave in a manner that does not endanger the safety of other persons, and in particular, to comply with the provisions of the Terms & Conditions.

Security Employees are entitled to:

• check and verify the rights to be in the Event area, and if a lack of such rights is established – call upon them to leave the Event,
• legitimate persons in order to establish their identity,
• browse through the contents of baggages and clothing of persons present in the Event area, in the event of suspicion that such persons are bringing or possessing objects whose possession in the Event area is prohibited under the Terms & Conditions,
• issue order instructions to persons disturbing public order or behaving in a manner inconsistent with the Terms & Conditions, and if such instructions are not followed – call upon them to leave the Event,
• apprehend persons obviously posing a direct threat to human life or health, as well as to protected property, in order to immediately hand such persons over to the Police;
• deny entry to the Event and participation therein to a person who:
• is under the visible influence of alcohol, narcotics, psychotropic substances, or other substances with a similar effect;
• possesses a weapon or other dangerous objects, explosive materials, pyrotechnic products, fire-hazardous materials, alcoholic beverages and food products, narcotics or psychotropic substances, or other products, beverages, agents, or substances whose possession is prohibited under the Terms & Conditions;
• behaves aggressively, provocatively, or otherwise poses a threat to security or public order;
• does not possess the rights to enter the Event area;
• fails to comply with the Terms & Conditions,
• remove from the area where the Event takes place the persons referred to in the preceding paragraph.

Security Employees may use or employ means of direct coercion as referred to in the Act of 22 August 1997 on the Protection of Persons and Property.

The use of means of direct coercion and the documentation of such use and employment by the security employees shall take place in accordance with the rules set out in the Act of 24 May 2013 on Means of Direct Coercion and Firearms.

In the Event area and in its close proximity, it is forbidden to:

• bring and possess weapons or other dangerous objects, explosive materials, pyrotechnic products, fire-hazardous materials, alcoholic beverages and food products (except those purchased from the Organiser), narcotics or psychotropic substances, tasers, pepper sprays, knives, clubs, chains, petards, smoke candles, lasers, laser pointers, as well as objects that could be used as projectiles and any objects similar to them, any glass, metal, and plastic packaging, as well as any sharp-pointed objects, gas cylinders, drones, and unmanned aerial vehicles,

• bringing and possessing audio and video recording equipment as well as photographic equipment, as well as taking photographs, recording sound, and filming without the written consent of the Organiser,
• conducting any commercial or other gainful activity without the permission of the Organiser,
• smoking tobacco and cigarettes outside the marked smoking zones,
• attending to physiological needs outside the toilets,
• throwing any objects,
• using open flame,
• making bonfires,
• using grilling devices,
• damaging greenery,
• vandalising the infrastructure located in the Event area,
• disturbing order and littering the area,
• bringing animals, with the exception of guide dogs,
• entering and parking motor vehicles, trailers, and other vehicles without the permission of the Organiser;
• bringing and possessing audio and video recording equipment as well as photographic equipment without the written consent of the Organiser, as well as making video and audio recordings;
• entering rooms marked with a "No Entry" sign or in another similar manner, climbing elements of the stage construction, stands, tent, containers, and IBC/mauser tanks,
• remaining in the Event area outside its duration hours,
• bringing and possessing a backpack, handbag, or other type of baggage larger than A4 size in the Event area.

All persons present in the Event area are obliged to follow the instructions of the security employees. A refusal to comply with such instructions may result solely from their conflict with generally applicable provisions of law.

A monitoring system in the form of audio and video recording devices is installed in the Event area. Monitoring is conducted in order to ensure the safety and security of persons and property. The data controller is the Organiser. Personal data obtained as a result of monitoring are shared with the company providing IT services, the security company, and institutions authorised by virtue of law. Monitoring data will be processed and stored for a period not exceeding 3 months from the date of the recording, unless the image recordings constitute evidence in proceedings conducted on the basis of law, or the Organiser has been notified that they may constitute evidence in proceedings – the period specified above shall be extended until the legally valid termination of the proceedings. After the expiry of the periods referred to above, the image recordings obtained as a result of monitoring and containing monitoring data shall be deleted, unless separate regulations state otherwise. Detailed information regarding the processing of personal data is available from the Organiser.

Stroboscopic lights may be used in the Event area, and persons present in the Event area may be exposed to continuous presence in a sound intensity zone, which may cause hearing damage. Pregnant women are exposed to particular danger.
