EVENT TERMS & CONDITIONS

 

  1. These Terms & Conditions, hereinafter referred to as the “Terms & Conditions,” is issued by Tomasz Ochab, conducting business activity as Tomasz Ochab Knock Out Productions, address: ul. Józefa Chełmońskiego 130L lok. 11, 31-340 Kraków (Poland), entered in the Central Registration and Information on Business of the Republic of Poland kept by the Minister of Economy, NIP (Tax ID No.): 6772280971, REGON (National Business Registry No.): 120675989, email: info@knockoutprod.net, hereinafter referred to as “Organiser.”
  2. The Terms & Conditions applies to all the people present in the artistic, cultural, entertainment or sport event area, hereinafter referred to as the “Event,” organised by the Organiser.
  3. The persons entitled to enter the Event area are adults who have presented the entry ticked issued by the Organiser as part of the pool of generally available tickets, or who have received the right to access the Event area individually from the Organiser.
  4. Persons entitled to access the Event area are the persons who have presented the entry ticket labelled as “Health Pass Ticket,”
    and, at the same time, on the day of entering the Event area, they have presented a valid EU Covid Certificate.
  5. The Organiser is entitled to verify at the Event entry point if a person with entry ticket labelled as “Health Pass Ticket” has a valid EU Covid Certificate. If such a person fails to present a valid EU Covid Certificate, access to the Event area shall be denied to this person, unless the legal regulations applicable as of the date of the Event state otherwise. Verification of the EU Covid Certificate shall take place by presenting a QR code in the mObywatel app or a printout downloaded from “Internetowe Konto Pacjenta” (Online Patient Account) and presenting a valid ID document. The details on the EU Covid Certificate must be the same as the details on a valid ID document.
  6. On entry to the Event, the entry tickets can be exchanged to IDs issued by the Organiser in the form of a wristband or a different form.
  7. Persons infected with the SARS-CoV-2 virus or presenting symptoms indicating infection with the SARS-CoV-2 virus, as well as persons under quarantine or epidemiological supervision cannot participate in the Event, unless the legal regulations applicable as of the date of the Event state otherwise. If an Event participant experiences any of the circumstances listed in the previous sentence during the Event, they are obliged to immediately inform the Organiser about this fact.
  8. Every person in the Event area shall be obliged to comply with all the epidemiological restrictions and the sanitary regime (specifically in relation to the COVID-19 epidemic) implemented on the basis of the legal regulations generally applicable in the Republic of Poland.
  9. The Organiser shall appoint security service in the Event area tasked with taking care of the security and safety of the persons present in the Event area, hereinafter referred to as the “Security Employees.”
  10. The Security Employees are obliged to carry a visible ID with the following information: name of issuer, ID no., face image, validity date, stamp and signature of issuer.
  11. The persons present in the Event area are obliged to have on their persons valid ID documents defined as: ID card, temporary ID certificate, passport, driving licence, school ID or university ID, foreigner ID document, or a different ID document with face image and age. At the entrance to the Event area, the Security Employees can demand from the persons entering the Event area to present such a document.
  12. A person under 13 can enter the Event only under the care of an adult with an entry ticket and/or other documents enabling them to enter the Event, as described in these Terms & Conditions, who, before entering the Event, has signed a declaration of taking responsibility for the minor in question, worded as in the template available at the entry to the Event. The parent/guardian is obliged to have a document with the child’s full name and age.
  13. Persons present in the Event area are obliged to behave in a manner not endangering others, and, specifically, to follow the Terms & Conditions.
  14. The Security Employees are entitled to:

 

  1. check and verify rights to be in the Event area, and if no such rights are identified – demand to leave the Event,
  2. check ID of persons in order to identify them,
  3. browse through the contents of bags and clothing of persons present in the Event area, and if such persons are suspected to bring or have objects forbidden in the Event area per the Terms & Conditions,
  4. issue orders to the persons disturbing public order or behaving in a way violating the Terms & Conditions, and if such orders are not followed – to demand to leave the Event,
  5. apprehend persons posing direct threat to the property or persons protected by the security as well as persons committing forbidden acts, in order to immediately hand them over to the Police.
  1. The activities taken up by the Security Employees should be performed
    in a way ensuring respecting human dignity and property of the persons subjected to such activities.
  2. The application of direct coercion and documenting such use by the safety or security personnel shall take place according to the rules determined in the Act of 24th May 2013 on the means of direct coercion and firearms.
  3. In the Event area and in its close proximity it is forbidden to:

 

  1. bring, carry, and use weapons or other dangerous objects, explosive materials, pyrotechnical products, materials presenting fire hazard, alcoholic beverages and food products (except the ones purchased from the Organiser), narcotics or psychoactive substances, tasers, pepper spray, knives, clubs, chains, firecrackers, smoke generators, lasers, laser pointers, or objects that might be used as projectiles, or any other similar objects, any sharp-edged objects, gas containers, solid or liquid fuel portable stoves, drones and unmanned aerial vehicles,
  2. conduct any commercial or other profit-making activity without the permission of the Organiser,
  3. smoke tobacco and cigarettes outside the marked smoking zones,
  4. tend to bodily needs outside the provided toilettes,
  5. throw any objects,
  6. use open flame,
  7. make bonfires,
  8. use grilling devices,
  9. destroy greenery,
  10. vandalise infrastructure in the Event area,
  11. disturb order and contaminate the area,
  12. bring animals, with the exception of guide dogs,
  13. drive in and park cars, trailers or other vehicles without permission of the Organiser,
  14. bring and have audio and video recording equipment or photo equipment without consent of the Organiser, and to take photographs, record audio and video,
  15. enter the rooms or premises labelled “Zakaz wstępu” (No entry) or similarly, climb elements of stage construction, stands, tent, containers or IBC containers,
  16. enter the Event area before and after the Event.
  1. The Security Employees are entitled to:

 

  1. verify rights to be in the Event area and check ID documents of persons in order to identify them;
  2. demand that persons leave the Event area if no rights to be there are determined or in the case of disturbing public order or violating the Terms & Conditions;
  3. apprehend in the Event area persons posing direct threat to human life or health, as well as to the protected property, in order to immediately hand them over to the Police;
  4. use or employ means of direct coercion, pursuant to the rules defined in the provisions of the Act of 22nd August 1997 on the protection on persons and property (Journal of Laws 1997 No. 114, item 740, as amended);
  5. use or employ firearms, pursuant to the rules defined in the provisions of the Act of 22nd August 1997 on the protection on persons and property (Journal of Laws 1997 No. 114, item 740, as amended);
  6. deny access to the Event area and the right to be there to a person which specifically:

 

  1. is visibly under the influence of alcohol, narcotics, psychoactive substances or other agents to similar effect;
  2. has a weapon or other dangerous objects, explosive materials, pyrotechnical products, materials presenting fire hazard, alcoholic beverages, narcotics, psychoactive substances, or other products, beverages, agents, or substances the possession of which is prohibited by the Terms & Conditions;
  3. is aggressive, provocative or otherwise poses threat to the security or public order;
  4. is not entitled to access the Event area;
  5. violates the Terms & Conditions, specifically does not comply with all the epidemiological restrictions and the sanitary regime (specifically in relation to the COVID-19 epidemic) implemented on the basis of the legal regulations generally applicable in the Republic of Poland.
  1. All the persons present in the Event area are obliged to follow orders of the Security Employees. A person can refuse to comply only if such orders violate the generally applicable legal regulations.
  2. A monitoring system shall be installed in the Event area in the form of audio and video recording devices. The monitoring activities shall be performed in order to ensure safety and security of persons and property. The Organiser acts as data controller. Personal data obtained as a result of the monitoring activities shall be shared with the company providing IT services, the security company, and institutions legally entitled to it. The data obtained from the monitoring activities shall be processed and stored for a period no longer than 3 months from the date of recording, unless the image recordings constitute proof in legal proceedings, or the Organiser has been informed that they can constitute proof in proceedings – the aforementioned period is extended until the proceedings have been validly completed. After the aforementioned periods have expired, the image recordings obtained as a result of the monitoring activities and including monitoring data shall be deleted, unless other regulations state otherwise.   3. In the Event area, stroboscopic lights can be used, and the persons present in the Event area can be exposed to constantly intensive sounds, which can be harmful to the hearing. Pregnant women are especially vulnerable.
